Delpech's Appeal Dismissed - Penalty Reduced

The Appeal lodged by Jockey A Delpech against the decision of the Racing Stewards made on 2 October 2007 to suspend him from riding in races for a period to expire on 15 November 2007 for a breach of Rule of Racing 99(2) and (3) was heard by the Stewards of the Jockey Club at 9:00 a.m. on 2 November 2007.

taken in this case together with the further statements taken in the hearing today.
The Panel dismissed the Appeal but decided to reduce the penalty imposed by the Racing Stewards on 2 October 2007. The Panel considered the appropriate penalty was a suspension from riding in races for a period which would cover 9 Hong Kong racedays. In deciding, the Panel considered the original penalty imposed by the Racing Stewards was to be served concurrently with a suspension for a period covering 2 Hong Kong racedays for careless riding in the same race. As Jockey Delpech had already served this period of suspension it was decided that period would be counted towards penalty. Having given Jockey Delpech credit for 2 racedays already served, his suspension will now take effect from 4 November 2007 and will expire on 29 November 2007, on which day he may resume riding in races (7 Hong Kong racedays).
The Panel further ordered the deposit refunded.

騎師杜鵬志的上訴結果

賽事秘書鄭育強承馬會董事局命發出通告如下：
馬會董事局於二○○七年十一月二日上午九時，就騎師杜鵬志提出的上訴進行聆訊。騎師杜鵬志於二○○七年十月二日被競賽董事小組裁定違反賽事規例第 99(2)及(3)條，判罰停賽至二○○七年十一月十五日才可再次出賽。他其後就此項罰則提出上訴。

上訴委員會慎重考慮了此宗事件的所有證供，以及在是日聆訊中所獲的進一步證供。
委員會駁回杜鵬志的上訴，但決定將競賽董事小組於二○○七年十月二日所判處的罰則減輕。委員會認為對杜鵬志的適當判罰應為停賽九個香港賽馬日。在作出這項判決時，委員會考慮到競賽董事小組原本所判罰則，乃與杜鵬志在同一場賽事中因不小心策騎而被罰停賽兩個香港賽馬日的處分同期執行。鑑於騎師杜鵬志已於該段期間停賽，委員會遂決定將該段期間計入罰則之內。扣除了騎師杜鵬志已停賽的兩個賽馬日之後，他現須於二○○七年十一月四日起停賽，直至十一月二十九日才可恢復策騎出賽（七個香港賽馬日）。
委員會並著令將保證金發還。
